“Colorado law has established that when someone is drunk or drugged, they are physically not capable of consenting. So, even if the pharmacist had not drugged the woman, the fact that she had been drinking would be enough to argue that she did not consent.(1) Any actor who knowingly inflicts sexual intrusion or sexual penetration on a victim commits sexual assault if:
(h) The victim is physically helpless and the actor knows the victim is physically helpless and the victim has not consented.”

In Castle Rock, Highlands Ranch, and Parker, Sexual Assault charged under subsection (h) I s a class 3 felony, punishable by an indeterminate sentence to the Colorado Department of Corrections. In this case, the Douglas County judge would set the minimum amount of time the man would spend in prison and the maximum would be set at life. After he has served his minimum, he would be able to appear in front of the parole board, but the decision to release him would be in their hands. Should they feel he is not ready, they can keep him incarcerated indefinitely.
