What Does Invasion of Privacy for Sexual Gratification Mean in Colorado?
Colorado criminal law prohibits observing or taking pics of someone’s private parts without their knowledge and permission. CRS 18-3-405.6 provides the definition of this offense in Colorado Springs. Police will pursue charges if they believe you:
- knowingly observed or took a picture / video,
- of another person’s intimate parts without their consent,
- for the purpose of sexual gratification
It’s important to note that in order for this to be a crime, it must be done somewhere the subject of the picture or video has a reasonable expectation of privacy. Changing rooms, locker rooms, and restrooms are examples that meet this requirement.
